Terms of Service

1. Service Agreement
By subscribing to Trimly LLC's robotic mowing service (“Service”), you (“Customer”) agree to these Terms of Service (“Terms”). Our Service includes the installation, maintenance, and operation of GPS-guided robotic mowers on your property.
You must be at least 18 years old and the owner or authorized tenant of the property where services will be provided. Tenants must provide written landlord authorization upon request.
2. Subscription & Automatic Renewal
Subscriptions are billed monthly in advance and automatically renew each month at the then-current rate until cancelled. This is a recurring charge. You may cancel at any time with 30 days written notice to hello@trimly-automow.com or by calling (864) 256-0999. Upon cancellation:
- Trimly will remove all equipment from your property at no additional charge within 14 business days
- No cancellation fees or early termination penalties apply
- Any prepaid amounts for unused service days after equipment removal will be prorated and refunded
Pricing may be adjusted with 30 days advance written notice. If you do not agree to a price change, you may cancel before it takes effect.
3. Property Requirements
Your property must meet certain requirements for service, including:
- Accessible lawn areas with suitable terrain (slopes under 24° for standard mowers)
- A suitable outdoor location for the charging station with access to a standard 120V power outlet
- Clear identification of property boundaries, gardens, pools, and other no-mow zones
- A working Wi-Fi network with adequate signal strength at the charging station location (see Section 6)
Trimly will assess your property during the initial consultation and reserves the right to decline or discontinue service if the property is not compatible with our equipment.
4. Equipment Ownership & Care
All robotic mowing equipment, charging stations, boundary devices, and accessories (“Equipment”) remain the sole property of Trimly LLC at all times, regardless of how long the Equipment has been installed on your property. Customers may not modify, sell, lease, pledge, relocate, or otherwise transfer or encumber any Equipment.
Trimly maintains theft and damage insurance on all Equipment. However, if Equipment is stolen or damaged as a direct result of Customer negligence (such as leaving gates or garages open against Trimly's recommendations, physically moving Equipment to an unsecured area, or intentional misuse), Customer may be responsible for repair or replacement costs up to the Equipment's depreciated value.
Upon termination or cancellation of service for any reason, Customer agrees to allow Trimly to retrieve all Equipment. If Customer prevents or unreasonably delays Equipment retrieval for more than 30 days after service ends, Customer agrees to pay the replacement cost of unreturned Equipment.
5. Customer Responsibilities
As a Customer, you agree to:
- Keep the mowing area free of debris, toys, hoses, and other obstacles that may damage the mower or be damaged by it
- Notify Trimly of any hazards, property changes, or landscaping work that may affect mower operation
- Provide reasonable access to the property for installation, routine maintenance, software updates, troubleshooting, and Equipment retrieval
- Not interfere with, attempt to repair, modify, or relocate the Equipment or its charging station
- Maintain a functioning outdoor power outlet accessible to the charging station
- Keep pets and children supervised near operating Equipment
6. Wi-Fi & Connectivity Requirements
Trimly's robotic mowers require a continuous Wi-Fi connection to operate, receive software updates, and report status to our monitoring systems. Customer is responsible for:
- Providing Wi-Fi network credentials during onboarding and promptly notifying Trimly of any changes to the network name (SSID) or password
- Maintaining an active internet connection with adequate signal strength at the mower's charging station
Trimly is not responsible for service interruptions, missed mows, or Equipment downtime caused by Wi-Fi outages, changed credentials not communicated to Trimly, insufficient signal strength, or internet service provider issues. Extended connectivity loss (more than 7 consecutive days without resolution after Trimly notification) may result in temporary service suspension without billing credit.
7. Seasonal Pause & Weather
Customers may request a seasonal service pause (e.g., during winter dormancy) by contacting Trimly at least 7 days in advance. During a seasonal pause:
- Monthly billing is suspended for the duration of the pause
- Equipment may remain on the property or be retrieved at Trimly's discretion
- Service resumes automatically at the agreed-upon date, and billing restarts at the then-current rate
Trimly uses weather-aware scheduling and may skip or delay mowing during heavy rain, extreme heat, or other adverse conditions. Missed mows due to weather are not grounds for billing adjustments, as the mower operates continuously during suitable conditions.
8. Liability and Insurance
Trimly maintains comprehensive general liability insurance covering our Equipment and operations. Trimly is responsible for:
- Normal wear and operation of our Equipment
- Repairs and maintenance of the robotic mower
- Replacement of Equipment stolen through no fault of the Customer
Trimly is not liable for: pre-existing lawn conditions; damage caused by undisclosed property hazards; damage to items left in the mowing path; injury to unsupervised pets or children; or service interruptions due to extreme weather, power outages, internet outages, or force majeure events (including but not limited to natural disasters, pandemics, government orders, supply chain disruptions, or acts of war).
TO THE MAXIMUM EXTENT PERMITTED BY SOUTH CAROLINA LAW, TRIMLY LLC'S TOTAL LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THIS AGREEMENT OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY CUSTOMER IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL TRIMLY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9. Property Access & Right of Entry
Customer grants Trimly and its authorized service personnel a limited, revocable license to enter the property as reasonably necessary to install, inspect, maintain, update, and retrieve Equipment. Trimly will provide reasonable advance notice (minimum 24 hours) for scheduled maintenance visits, except in emergencies or for routine Equipment retrieval upon cancellation.
10. Data Collection & Mower Telemetry
Our robotic mowers collect operational data including GPS location, mowing patterns, battery status, terrain mapping, obstacle detection events, and connectivity status (“Telemetry Data”). This data is used to monitor Equipment health, optimize mowing performance, and provide proactive maintenance. Telemetry Data is governed by our Privacy Policy.
11. Intellectual Property
All Trimly trademarks, logos, website content, and software are the intellectual property of Trimly LLC. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
12. Dispute Resolution
Any disputes arising from these Terms shall first be addressed through good-faith negotiation between the parties for a period of at least 30 days. If a resolution cannot be reached, disputes shall be resolved through binding arbitration in Greenville County, South Carolina, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction. Small claims court actions (where the amount in controversy is within the jurisdictional limit) are exempt from this arbitration requirement.
Class action waiver: All disputes must be brought in an individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
13. Indemnification
You agree to indemnify, defend, and hold harmless Trimly LLC, its members, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, misuse of the Equipment, undisclosed property hazards, or failure to fulfill your responsibilities under this agreement.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law principles.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with the signed proposal and Privacy Policy, constitute the entire agreement between you and Trimly LLC regarding the Service. No oral or written representations outside of these documents shall be binding.
17. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to material changes, you may cancel your subscription before they take effect.
